State Administrative Procedures Act (SAPA)


The State Administrative Procedure Act (SAPA) establishes minimum procedures for State agencies to follow to adopt rules, including publication and public participation requirements. SAPA requires agencies to publish the text of the rule in the State Register along with: 

The RIS should, among other things, describe the need for and benefits of a rule, costs associated with a rule, and the agency's statutory authority to propose the rule. The RFASB, RAFA, and JIS further document the rule's impact with respect to small businesses, rural areas, and jobs and employment opportunities. Pursuant to Executive Order No. 20, the Governor's Office of Regulatory Reform ensures that these documents contain information adequate for interested parties to evaluate the rule's impact.

The Executive Order's review criteria builds upon SAPA's requirements. In addition to reviewing the above regulatory documents, GORR also evaluates whether the rule is consistent with state statutes in:

  • producing benefits which outweigh its costs
  • prescribing methodologies or requirements that allow flexibility and encourage innovation giving preference to the least costly, least burdensome requirements needed to accomplish legislative and administrative objectives and is based upon the best scientific, technical and economic information that is reasonably available.
